Welcome to The Mind Sync Kids! This Privacy Policy applies when you access and use the website located at www.themindsynckids.com (the “Website”), The Mind Sync Kids mobile application (the “App”), any resources, materials, sessions or other services offered by the Company.

The Website, the App, and all services, resources, and materials made available by the Company are hereinafter collectively referred to as “Service/s.” The Services are owned and operated by TheMindSync LLC (hereinafter “the Company,” “we,” “us,” or “our”) in accordance with the laws of Florida, United States.

This Privacy Policy describes what personal information we collect from you when you use our Services; how such personal information is used; how we protect it; when we disclose your personal information to third parties; and your rights relating to your personal information.

If your child is under the age of 13, we have incorporated procedures and policies to ensure that our privacy practices comply with the Children’s Online Privacy Protection Act of 1998 (‘COPPA’). The Service requires user account registration, which in the case of children under 13, must be done by parents/legal guardians. Parents remain in full control of their child’s personal information and may revoke their consent at any time.

    The following words, whenever used in this Privacy Policy, will have the meaning given to them below:

    ‘Account’ means the account that enables a user to log into the App and use the features and functionality provided by the Company. Any reference to an account includes parent-managed accounts.
    ‘Account Owner’ means a user who registers an account for the Service. Please note that for children under the age of 13, the account owner is the parent who registers the account that may be used by a child under such person’s parental responsibility.
    ‘Instructor’ means a contractor or employee of the Company who delivers individual lessons from the program to users through a virtual session.
    ‘Parent’ shall have the meaning as defined in Section 3 of these Terms and Conditions.
    ‘Parent-managed accounts’ shall have the meaning as defined in Section 3 of these Terms and Conditions.
    ‘the Program’ or ‘the Mind Sync Program’ means the Company’s proprietary social-emotional learning curriculum that is made available through the App and during sessions by instructors.
    ‘Session’ means the virtual, one-on-one lessons delivered by instructors to users.
    ‘User,’ ‘you,’ or ‘your’ means the person applying for an account, the account owner, and the child who uses the Service under the supervision of the account owner.

    2.Scope

    This Privacy Policy only covers the personal information that we process when you access and use our Service.

    3. What personal information do we collect from you?

    The personal information we collect from our users includes but is not limited to:

    • Full name of the account owner;
    • Date of birth of user registering the account;
    • Email address of the account owner;
    • Child’s full name (if the child is under 13 and not the account owner);
    • Any information you provide us voluntarily;
    • Content of all communication you have with the Company (including any communication with instructors through email);
    • Information that you provide us when participating in our surveys or promotions;
    • Your log data, including your browser type, time and pages you visit, your IP address, etc.;
    • Device data, including the mode and make of your device, operating system, and unique device identifiers.

    4.How do we collect and use your information?

    Voluntarily submitted information

    4.1. Account Owner Information

    We collect personal information from individuals when they apply to register an account.

    4.1.1. Process

    During account registration, we request the date of birth of the user who is applying for the account to determine if COPPA applies.

    If the date of birth indicates that the user is 13 years or older, they can proceed with the account registration process themselves by providing their full name and a valid email address. However, if the date of birth indicates that the user is under 13 years old (”child”), we do not allow the child to proceed any further, and the child is prompted to request his/her parent to apply for the account.

    4.1.2. COPPA Compliance

    Parents can apply for an account by providing their full name, email address, and consent to collect their child’s personal information, as outlined in Section 4.1.3 below. Upon receipt of the parent’s consent, the App allows the parents to add their child’s personal information on the App by logging into their account.

    4.1.3. How we verify consent

    We collect verifiable consent from parents in a COPPA-compliant way as follows:

    1. We send a direct notice to the email address provided by the parent during account registration. If the parent consents to our collection of their child’s personal information, they can reply to our email with the words “I consent.”

    2. Upon receipt of the parent’s consent email, we send a confirmation email to the parents outlining how they can add their child’s personal information through their account on the App and how they may revoke their consent.

    Parents may revoke their consent at any time by following the steps outlined in our confirmation email or by requesting account termination in accordance with the provisions of Section 8 of our Terms and Conditions.

    As the account owner, the parent is responsible for deciding what personal information is shared with the Company or its instructors. The parent is also responsible for monitoring what user content their child submits through the App and supervising all sessions with the instructor.

    We use the account owner’s personal information to:

    • To create the account and enable the account owner to securely sign in;
    • To obtain verifiable consent and help with recovering any lost password;
    • To enable the account owner and to add their child’s personal information to their account and to enable the child to use the Service.
    • To send the account owner relevant updates and other important notices about our Services.

    4.2. Support Communication Information

    When you send any support requests or inquiries to us, we collect and use your personal information, such as your name, email address, and the content of your message, to:

    • Respond to your inquiries and offer customer support services;
    • Detect and prevent unauthorized activities on the App.

    4.3. Session Information

    Our instructors may receive some personal information about our users during the live sessions. All such personal information is only used to deliver The Mind Sync program to the users, and this information is not used for any other purposes.

    4.4. Marketing Information

    We collect some personal information you directly submit to us when you subscribe to receive marketing material from us, such as your name and email address and any personal information you provide us with when you voluntarily participate in our surveys/promotions.

    We use this information to:

    • Send you marketing material that we think you will find interesting;
    • Create new Service offerings or improve our existing Services;
    • Fulfill any other purpose specified at the time we collect your information.

    You may withdraw your consent at any time by unsubscribing from the marketing emails.

    Automatically collected information

    4.5. Log, Device, Location, and Cookies Data

    When you access the App, we may automatically collect some personal information about you, including but not limited to the following:

    • your Internet Protocol (“IP address”),
    • your browser type or version,
    • the data on the time and date of your visit,
    • other data collected through web beacons, pixel tags, and cookies.

    We may use this information to:

    • Deliver and improve the Service;
    • Send you updates and alerts;
    • Detect and prevent fraud and protect our users.

    We may also use any information we collect for our legal compliance and/or to assert our legal rights or defend any claims.

    5. Disclosure of your personal information

    We respect your personal information, and we do not engage in the practice of selling or renting your personal information. We will only disclose/share your personal information under following circumstances:

    5.1. Service Providers

    We may disclose your personal information to our third-party service providers (“Service Providers”) who help us with the performance of our business operations, such as emailing tools, video conferencing services, analytics, marketing, customer support, and other purposes for which your personal information is processed as described in Section 4 of this Privacy Policy. We may also partner with App Stores ("Partners'') to distribute our mobile application. These App Stores may act as independent controllers of your personal information, and their legal agreements and privacy policies will govern your relationship with them in addition to this Privacy Policy.

    5.2. Change of ownership

    If, in the future, we enter into any sale/purchase negotiations or transactions with another business, your personal information may be disclosed to such other businesses as part of negotiations and/or due diligence. If any commercial transaction results in a change in ownership of the Company, the personal information we process may be transferred to the new entity as part of the commercial transaction. Please note that in the aforementioned scenarios, your personal information will continue to be governed by this Privacy Policy, except in cases where you expressly consent otherwise.

    5.3. With your consent

    We may share your personal information with third parties with your express consent.

    5.4. To protect ourselves or our users

    We may be required to disclose your personal information to law enforcement authorities and other government bodies to comply with the law, to enforce our Agreement with you, to defend ourselves in legal actions, or to protect our users or others from threats posed by your actions by sharing your data with relevant bodies/entities.

    5.5. Anonymous statistical data

    We may share anonymous statistical data we collect from you during your use of the App with third parties for our business purposes.

    6. Security of Personal Information

    The App is designed with the security of personal information in mind. We restrict access to your personal information within our Company on a need-to-know basis to prevent unauthorized access. All accounts are password-protected and we do not allow users to share their passwords with others. We do not process any sensitive information, such as the payment data of our users. Regardless of the security measures that we have put in place, you acknowledge that data transmission over the internet is never one hundred percent secure. Accordingly, we cannot offer any guarantees regarding the absolute security of your personal information.

    7. Information Retention

    We will not retain your personal information longer than we are required to keep it for the purpose for which we initially collected it. We will securely purge your personal information or anonymize it after we no longer require it, so it cannot be linked back to you as an individual.

    8. Your Rights and Choices

    8.1. Account Information

    As the account owner, you have the right to access, edit, update, or request the deletion of all personal information associated with your account.

    If you have a parent-managed account, you may also access, edit, update, or request the deletion of any personal information you added to your account about your child. You can access, edit or update your and your child’s personal information by accessing the account settings in the App.

    To request the deletion of your account information, you must send an email to your instructor through the email address linked with your account.

    Parental Controls

    In addition to the above, as a parent, you can also refuse to permit the Company from collecting further personal information from your child at any time. You can also contact us to discuss our children’s privacy practices.

    8.2. Marketing Data

    When you opt-in and subscribe to receive marketing communication from us, we may send you marketing materials via email. You have the choice to withdraw your consent from receiving direct marketing material from us at any time by simply clicking the unsubscribe link in our email. Please note that we may still send you service-related notices and policies until your account is terminated.

    9. International Data Transfer

    The Company is based in the United States, and your personal information will be transferred and processed in the United States as well as other parts of the world. By using our Service, you expressly consent to the use and disclosure of your personal information in accordance with this privacy policy. If you are in the European Economic Area, United Kingdom, or Switzerland, and your personal information is transferred and processed in a jurisdiction that is not deemed adequate by the European Commission, we will only transfer your personal information pursuant to appropriate Standard Contractual Clauses as required by the EU General Data Protection Regulation or UK General Data Protection Regulation (as applicable).

    10. Do Not Track (‘DNT’)

    We currently do not respond to DNT signals.

    Our Service may contain links that will redirect you to third-party websites. Such third-party websites are not owned or operated by us, and they are governed by their own legal Terms and Privacy Policies. You understand that the presence of any third-party links on our Website/App does not constitute an endorsement of such a third party, and we cannot be held responsible for such a third party’s actions.

    12. Amendments

    From time to time, we may amend this Privacy Policy to reflect our new privacy practices and commitment to compliance with applicable privacy laws and regulations. We will post the updated Privacy Policy on this page and notify you of such updates by changing the last updated date on the top or by sending an email (if required by law). You should review this Privacy Policy regularly to ensure that you are familiar with any changes. You understand and accept that your continued use of the Services after the updates become effective will be deemed as acceptance of such updated privacy practices.
